Service Policy of Network for Small Business
Networking for Small Business - hereafter referred to as NET4SB or
net4sb - provides computer-networking service, Internet web hosting,
domain name reservation, e-mail service, computer training and web
page development. NET4SB’s general policy is to act as a computer
repairman or page designer. Although we do take care of computer
hardware, network component, e-mail, and website that we service, we
are not responsible for any damage or expenses directly or indirectly
cause by any failure of these devices or services. NET4SB accepts no
legal responsibility for breakdown nor guarantee the devices or
services run without interruption. We do not accept any liability to
any person who does rely on it inappropriately.
NET4SB
endeavors to maintain in good condition office facilities,
laboratories, and computer equipment for training purpose.
Individuals who use our facilities do so at their own risk. Absent
its own negligence, NET4SB has no legal responsibilities for injuries
or other damages or expenses suffered by trainees on or off the
facilities or in travel to and from such activities. NET4SB is not
responsible for the security of the personal property of trainee. We
recommend that trainees or their parents provide insurance coverage on
personal belongings brought on our office or laboratories.
NET4SB’s Tech Support page is for information services and is not an
advertisement. We are not responsible for the content of any other
website including any site through which you may have gained access to
our site or to which you may gain access from our site. We do not
accept any liability in connection with any such sites or links.
Nothing on this site constitutes a binding offer to perform any legal
service in any jurisdiction. You are responsible for obeying all
applicable copyright laws. We permit you to make copies of our site
as necessary incidental acts during your viewing of it; and you may
make a print for your personal use of so much of the site as
reasonable for private purposes, but you must not otherwise copy it,
use it, or re-publish it whole or in part without this section nor
without first obtaining written consent from us, NET4SB. NET4SB
reserves the right to suspend or cancel a customer’s to any or all
services provided by NET4SB.
Privacy Policy
NET4SB use your IP address to help
diagnose problems with our server, and to administer our Web site. Our
site uses cookies to keep track of your shopping cart. We use cookies
to deliver content specific to your interests and to save your
password so you don't have to re-enter it each time you visit our
site. This site contains links to other sites. NET4SB. is not
responsible nor can it be held liable for the privacy practices or the
content of such Web sites. We will not disclose or distribute your
information to or with any third-parties, for whichever purpose it may
be. Never will any third-party consciously gain access to your
personal information.
NET4SB uses an order form for customers to request information,
products, and services. We collect visitor's contact information (like
their email address). Contact information from the order form is used
to send orders and information about our company to our customers. The
customer's contact information is also used to get in touch with the
visitor when necessary.
NET4SB would make chat rooms, forums, message boards, and/or news
groups available to its users. Please remember that any information
that is disclosed in these areas becomes public information and you
should exercise caution when deciding to disclose your personal
information.
NET4SB has security measures in place to protect the loss, misuse and
alteration of the information under our control. We have excellent
anti-hacking software in place that was either purchased from
third-parties and or programmed by our in-house developers. There is
hardly any risk of information being compromised or accessed by any
unauthorized parties.

abuse – Any attempt to undermine or cause harm to a server or customer
of NET4SB is strictly prohibited.
Unauthorized use of other people’s accounts or computers
NET4SB
will strongly react to any use or attempted use of an Internet account
or computer without the owner’s authorization. Such attempts include
“Internet scamming” (tricking other people into releasing their
passwords), password robbery, security hole scanning, etc. Any
unauthorized use of accounts or computers by a NET4SB customer whether
or not the attacked account or computer belongs to NET4SB will result
in action against the attacker. Possible actions include warnings,
account suspension or cancellation, and civil or criminal legal
action, depending on the seriousness of the attack.
Adult Sites and Place Adult Material On Their Sites
Any
type of pornographic materials, hate materials, adult materials (adult
material is not necessarily limited to pornography), racial material,
or unlawful practices are prohibited.
Utilization Limitations and/or Unlimited Storage
NET4SB’s customers are privileged to be offered an unmonitored account
in terms of bandwidth. This means NET4SB does not pro-actively
monitor bandwidth usage of our customers. NET4SB’s bandwidth policy
is similar to the common Laissez-Faire model in politics. Customers
are entitled to use as much bandwidth as necessary as long as they (a)
do not harm other customers located on the same machine or on other
machines of NET4SB’s network and (b) do comply with all other terms
and conditions. All domain/subdomains do have a moderation throttling
utility applied to their throughput. This moderation throttling
utility measures the accounts usage based on averages derived from
various server tasks and services such as average CPU utilization, FTP
utilization, HTTP bandwidth utilization, E-mail utilization,
etcetera. On basis of the meaningful average value the moderation
throttling software decides if a delay of the offending account is
determined to be necessary in order to assure 100% service uptime,
reliability, performance for other websites of moderate usage on the
same machine. HTTP moderation is set to 57 million bits per hour (in
numbers: 57,000,000 bits/hour), other limitations are determined
depending on average usage of the server by all clients on the same
machine and hence depend.
The
intention of NET4SB is to provide a large space to serve wed
documents, not an offsite storage for electronic files. All of your
download files or files stored on the server have to be available for
download via a HTML document stored on the Internet in a publicly or
privately accessible area. This policy does ONLY apply to web sites
who are considered to be abusing services - HTTP and disk space
utilization in particular. It is NOT applicable to photo galleries,
even if several hundred megabytes are in use. PHOTO galleries and/or
any kind of presentation websites are more than welcome to host on
NET4SB and are only bound to utilization policy. Web sites that are
found to contain either/or no html documents, and/or a large number of
unlinked files are subject to warning, suspension, or cancellation at
the sole discretion of NET4SB management.
Any
customer who violates NET4SB’s policies in abusing any policy will not
necessarily be notified, in rare cases, NET4SB has to temporarily
deactivate and/or turn off hosting accounts without prior notification
and/or reason. If no action takes place on customer side for
initiating reactivation of hosting account and stop usage of service,
hosting account will be terminated permanently without refund.
Commercial advertisements with e-mail unsolicited commercial
advertisements are not allowed in e-mail (commonly known as SPAM or
UCE) and will result in account suspension or cancellation.
Commercial advertisements are un-welcome in most Usenet discussion
groups and on most e-mailing lists. Inappropriate may result in
account suspension or cancellation. See the newsgroup or mailing
list’s charter for whether advertising is allowed or not. “Spamming”
or sending a message to many different off-topic newsgroups is
particularly unethical and will be treated as breach of this ethical
policy.
Payment Policies
Net 30
days. No cash discounts.
Verbal
agreements are not recognized.
Technical requirements shall be provided for every contract/job by
service receiver and shall clearly state the following information:
service receiver’s name, address, necessary contact information,
project name and/or project number, project due date, plus any special
instructions. No conditions, printed or otherwise, appearing on the
space order, billing instruction or copy instruction which conflict
with NET4SB stated policies will be binding on the service provider.
Orders are acceptable for not more than one year in advance. A
contract year, or 12-month period, starts from the date of the first
Service Agreement. Twelve-month periods do not overlap. Early
termination of a service contract without NET4SB written agreement
results a penalty charge at $5000.00 per contract.
All
e-mail accounts are set up on an annual pre-pay basis. A free domain
registration is provided with bundled services. Such domain will be
registered with NET4SB’s proprietary bulk registration system and may
or may not show proprietary contact information. In any case and in
the event customers wish to move their domain name to another
provider, NET4SB will not play a hindering role. Customer is welcome
to request move of domain name registered through NET4SB to another
provider anytime and NET4SB will immediately work on request and
initiate process to remove the domain name from NET4SB’s bulk
registration system. Customer can then register this domain name with
any other provider, as customer’s preference. NET4SB includes ANY and
ALL fees for the domain name, they also include the InterNIC fee for
the one domain registration since it will be paid in full by NET4SB.
If
client is hosting with Web Design Package, NET4SB will be paying
InterNIC fees for the time client is hosting with NET4SB. All pricing
is guaranteed for the term of pre-payment. NET4SB reserves the right
to change prices at any time for *new* customers only. Existing
customers have, as soon as an order is placed, a price-lock on their
account and are guaranteed to ALWAYS receive the same or lower price
than they originally signed up for. Hence customers will never face
or incur higher or increased charges. Unless other terms have been
agreed upon, an account not brought current within a week (7 days) of
e-mail notice or exceeding this time frame in any way is subject to
suspension. The customer is responsible for all money owed on the
account from the time it was established to the time the customer
notifies NET4SB in online writing for a request for termination of
services. All payment is in U.S. currency.
Cancellation
NET4SB
reserves the right to cancel service at any time due to policy
violations. If NET4SB institutes its right of cancellation, no
pro-rated fees will be refunded or credited as policies have been
violated. Each customer is expected to use his/her account for the
purpose of maintaining a web site only, with responsibility and
respect towards other Internet users. Common sense is the best guide
as to what is right and wrong, it’s the same guide we’ll use when
analyzing an event of bad behavior. Net 4sb has the right to deny
business to a customer, if this customer is being rude to a member of
our staff, attempting to re-open an account after the user’s account
has been previously canceled due to a policy violation, constantly
creating problems on a server, constantly having billing problems
(credit card denied way too often, checks bounding, etc), demanding or
expecting in a rude fashion more than what our service provides or
what we can do (“I want you to install X software for me. Do it now
or else”, “I want more, E-mail accounts for free. I’m the customer
and you have to satisfy me. So give me the extra accounts”, etc).
Always be polite. If customer is not polite, NET4SB reserves to no
longer provide customer with web hosting service. If NET4SB decides
to stop providing customer service due to any of these reasons, the
account will be terminated immediately. Any violation of policies
which results in extra cost will be billed to the customer (i.e.
transfer, space, server destruction, server damage, devastative
behavior, hacking, phreaking, phroning, etc).
Chargeback and Dispute Policy
NET4SB
does not allow chargeback to occur to its merchant accounts and
contracts with VISA/MC International, American Express Bank Ltd. and
Discover Card services. It is not recommended to initiate a
chargeback hence customer agreed to AUP (this document) and Terms and
Conditioned as outlined in this document and NET4SB will use this
document and customer’s agreement at the time of order to
wholeheartedly fight a chargeback and/or dispute. If customer
supplied a valid reason for refund, NET4SB will gladly apply a refund
ONLY if requirements as specified above are met. Any
dispute/chargeback attempts will immediately result in suspension of
web hosting account and another charge applied to the customer credit
card under the same order/authorization number. NET4SB reserves the
right to re-charge customer credit card anytime in the event of a
dispute and/ or chargeback process.
